Court of Protection Solicitor - London - £65K



My client is seeking a dedicated and experienced Court of Protection Solicitor to join a highly regarded team. Recognised by Chambers and Legal 500, the team specialises in handling complex Court of Protection cases, often involving vulnerable individuals. This role offers the opportunity to work on a variety of challenging matters, including property, financial affairs, and health and welfare decisions under the Mental Capacity Act 2005. About the Role

As a Court of Protection Solicitor, your key responsibilities will include:



Responsibilities

  • Advising clients, families, and carers on mental capacity issues and the Court of Protection process.
  • Preparing and managing applications to the Court of Protection, including deputyship appointments, statutory wills, and complex financial or health-related decisions.
  • Acting as a professional deputy or supporting lay deputies in managing clients’ property and financial affairs.
  • Handling a range of matters, including Property and Affairs Deputyships, Trust management, tax affairs, drafting Personal Injury Trusts, Statutory Wills, and Welfare Deputyship applications.
  • Resolving disputes related to the Court of Protection, such as challenges to capacity or disagreements about deputyship and health and welfare decisions.
  • Preparing and reviewing Lasting Powers of Attorney and advising on their registration and use.
  • Collaborating with healthcare professionals, social services, and other stakeholders to ensure clients’ best interests are met.
  • Providing training and updates to clients and colleagues on developments in Court of Protection law and practice.
  • Maintaining accurate records and adhering to all regulatory and professional standards.


Qualifications

  • Qualified solicitor in England and Wales with 2-5 years’ post-qualification experience (PQE) in Court of Protection matters.
  • Strong knowledge of the Mental Capacity Act 2005 and associated codes of practice.
  • Ability to work independently and manage a caseload efficiently.
  • Exceptional communication and client care skills, with a sensitive approach to complex family dynamics.
  • Proactive, organised, and capable of working under pressure to meet deadlines.
  • Strong understanding of financial matters and excellent analytical skills.
  • Commitment to maintaining high standards of professional ethics and confidentiality.
